Engagement agreement
An engagement begins when both parties have agreed to the scope of work and any deposit has been received. Briefs submitted through our website do not constitute an engagement agreement.
Each engagement is governed by a written agreement that sets out the scope of work, timeline, deliverables, payment schedule, and intellectual property terms. No work begins before this agreement is signed by both parties.
Payment
Project-based engagements require a deposit before work begins, with the remaining balance due on an agreed schedule. Ongoing engagements are billed monthly. Exact payment terms are set out in the individual engagement agreement.
All fees are quoted in Canadian dollars unless otherwise agreed. We accept bank transfer and major credit cards.
Revisions
Each engagement agreement specifies the review and revision process for that scope of work. Requests for changes beyond the agreed scope are quoted separately.
Intellectual property
Upon receipt of final payment, the client receives a licence to use the completed deliverables for their intended purpose, as set out in the engagement agreement. Casa di Marca retains the right to reference the engagement in its portfolio and case studies, unless the client requests otherwise in writing before the engagement agreement is signed.
Source files and working assets remain the property of Casa di Marca unless a full intellectual property transfer is agreed and paid for separately.
Cancellation
If a client cancels a project-based engagement after work has begun, any deposit is non-refundable. Ongoing engagements may be cancelled by either party with the notice period set out in the engagement agreement. If Casa di Marca is unable to complete an engagement for any reason, the client will receive a full refund of all unearned fees paid.
Limitation of liability
Casa di Marca's liability in connection with any engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential, or incidental damages.
Governing law
These terms and all engagement agreements are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the courts of British Columbia.
